In Astle v Cheshire County Council and others  IRLR 12 EAT, the Employment Appeal Tribunal held that the tribunal did not misdirect itself in finding that the council's main reason for adopting a new structure that did not involve a workforce was an economic reason rather than a deliberate attempt to evade TUPE.
