In Caisse Nationale d'Assurance Vieillesse des Travailleurs Salaries (CNAVTS) v Thibault the European Court of Justice has ruled that it is contrary to the EC Treatment Directive to deny a woman on maternity leave an annual performance appraisal necessary for a pay increment.
