Commission for Racial Equality v Dutton [1989] IRLR 8 CA

Reports relating to this case:

  • Gypsies held to be a "racial group"

    Date:
    1 January 1989

In Commission for Racial Equality v Dutton (27.7.88) EOR23C, the Court of Appeal holds that gypsies are a group defined by reference to "ethnic origins" within the meaning of the definition of "racial group" in the Race Relations Act 1976 (RRA) and that a notice in a pub prohibiting "travellers" was prima facie indirectly discriminatory against gypsies.
