In Ezsias v North Glamorgan NHS Trust  IRLR 550 EAT, the EAT held that a dismissal because of a breakdown in working relationships was a fair dismissal "for some other substantial reason" rather than conduct, even though the employee's behaviour was the cause of the breakdown.

The Employment Appeal Tribunal has held that, where an employee is dismissed primarily because of a breakdown in trust and confidence rather than conduct, the employer's contractual disciplinary procedures will not apply.
