In Gordon Lodge Nursing Home v Jama, the EAT affirms that a constructive dismissal will not automatically be unfair. The issue of reasonableness must be addressed by the industrial tribunal in all cases of dismissal, express and constructive. The EAT also affirms that the fact that an unfair dismissal was constructive does not preclude a tribunal from reducing compensation on the basis of the employee's contributory fault.
