In Mba v Mayor and Burgesses of the London Borough of Merton  IRLR 145 CA, the Court of Appeal held that an employer had been justified in requiring a Christian employee who believed in strict Sunday observance to work on Sundays. Accordingly her claim of unlawful religious discrimination failed.

The Court of Appeal has found that the employment tribunal was correct to reject the indirect religion or belief discrimination claim brought by a Christian care worker who resigned after a dispute with her employer over her refusal to work on Sundays.
