Murphy v Sheffield Hallam University EAT/6/99

Reports relating to this case:

  • Disability discrimination: Non-selection of disabled candidate was not for reason related to disability

    Date:
    15 February 2000

In Murphy v Sheffield Hallam University, the EAT upholds an employment tribunal's decision that a disabled person's deafness had played no part in the decision not to offer him a job for which he had applied. He was treated less favourably than the successful candidate, who was not disabled, but his disability was not an effective cause of the less favourable treatment. The sole reason for the decision to select the other person was that he was the best candidate.
