In Royal Liverpool Children's NHS Trust v Dunsby EAT/0426/05, the Employment Appeal Tribunal held that a dismissal on the grounds of absence was not unfair simply because some of the absence taken into account was disability-related. It is open to employers to show that dismissals for disability-related absences are justified.
