The facts

Miss Coales made an application to the Industrial Tribunal under s.11 of the Employment Protection (Consolidation) Act alleging that her employers had failed to provide her with an itemised pay statement. An employee's right to an itemised pay statement arises under s.8 of the Act which provides that: "Every employee shall have the right to be given by his employer at or before the time at which any payment of wages or salary is made to him an itemised pay statement, in writing ..."

In the present case, the Industrial Tribunal held that Miss Coales had never been denied the right to an itemised pay statement since, "On the few occasions that she wished to have details of the deductions that were made, such deductions were explained and shown to her".
