Constructive dismissal: All breaches of duty of trust and confidence entitle employee to resign and claim constructive dismissal

In Morrow v Safeway Stores plc 17.5.01, EAT 275/00, the EAT holds that any breach of the implied duty of trust and confidence will inevitably be repudiatory, entitling the employee to resign and claim constructive dismissal. In holding that the employer had breached the implied term but not sufficiently seriously so as to entitle the employee to resign, the employment tribunal had erred in law.
