A council was "vicariously" liable for the actions of a "back-bench" elected councillor who behaved abusively towards a council employee on council premises during office hours, holds the EAT in Moores v Bude-Stratton Town Council 27.3.00 EAT 313/99. The councillor's conduct was capable of amounting to a breach by the council of its implied contractual obligation to the employee to provide him with a reasonable congenial working environment, and his complaint of constructive unfair dismissal should be considered on that basis.
