Court of Appeal endorses discovery of ethnic monitoring statistics

In West Midlands Passenger Transport Executive v Singh (18.3.88) EOR19A, the Court of Appeal rules that evidence that an employer has or has not appointed any or many ethnic minority applicants in the past is material to whether he has discriminated on racial grounds against a particular complainant. Accordingly, complainants are entitled to discovery to ascertain the percentages of successful minority applicants and successful white applicants.
