In Stark v The Post Office, theCourt of Appeal rules that reg. 6(1) of the Provision and Use of Work Equipment Regulations 1992 (PUWER) imposes on an employer absolute liability for defective equipment. As a result, a postman injured when riding his Post Office bicycle is entitled to damages.
