In RummIer v Dato-Druck GmbH 1.7.86 Case 237/87, the European Court of Justice rules that a job evaluation scheme which falls to take into account criteria for which workers of each sex may show particular aptitude may be in breach of EEC sex discrimination law.

Article 1 of the EEC equal pay directive provides for the elimination of discrimination on grounds of sex with regard to all aspects and conditions of remuneration for the same work or for work to which equal value is attributed.
