In Higgins v Empatico Childrens Services Ltd a Nottingham employment tribunal (Chair: S Keevash) has held that it was indirect sex discrimination to require a woman working night shifts to work days, where she could not make satisfactory childcare arrangements.

Mrs Higgins was employed as a care assistant in March 1998, working from 10 pm to 8 am.
