In Jones v Mid-Glamorgan County Council  IRLR 685, the Court of Appeal upholds an industrial tribunal's finding that an individual's employment terminated by agreement through a genuine voluntary retirement rather than by dismissal. That conclusion was not vitiated - as the EAT had wrongly held - by references in the tribunal's decision to findings of the county court, on a dispute between the parties which raised analogous but different issues, as being "binding" on it.
