In Gateshead Metropolitan Borough Council v Mills 8.6.95 EAT 610/92, the EAT holds that an employee under notice of redundancy, who accepted his employer's offer of early retirement as an alternative to seeking re-employment or being made redundant, was dismissed. The agreement was not inconsistent with a dismissal, since the redundancy notice was never withdrawn. Therefore, the employee was entitled to a redundancy payment.
