An employer that was the trustee and administrator of its pension scheme had no duty of care in tort to advise a returning employee with regard to whether he should apply to rejoin the scheme, holds the Court of Appeal in Outram v Academy Plastics 19.4.00 Court of Appeal. In this case, the employer was under no express or implied contractual duty to provide such information and advice, and as there was no contractual obligation none could be derived from the tort of negligence.
