A voluntary-aided church junior school is an "emanation of the state" for the purposes of EC law, holds the Court of Appeal in National Union of Teachers and others v Governing Body of St Mary's Church of England (Aided) Junior School and others 12.12.96 Court of Appeal. Teachers who were dismissed when the school closed down were consequently entitled to rely directly on rights contained in the EC Business Transfers Directive in proceedings against the school's governing body.
