The House of Lords in Vehicle Inspectorate v Nuttal finds that an employer that chooses not to examine its drivers' tachograph records fails to take the steps a reasonable employer would take to prevent it contravening the "drivers' hours" Regulation and, on the face of it, "permits" its employees to contravene the Regulation.

The case arose out of the prosecution of Mr Nuttall, the operator of a coach company, by the Vehicle Inspectorate.
