A dentist who provided a general dental service from his surgery on a self-employed basis worked under a contract of employment with the local health authority in respect of the service he provided at the local hospital under a rota providing emergency dental services for the area, holds the EAT in City and East London Family Health Services Authority v Durcan 24.9.96 EAT 721/96. Although he worked only five hours a week under this arrangement, and for administrative purposes the hospital labelled him self-employed, there was sufficient mutuality of obligation for a contract of employment to exist.
