The difference in the pay scales and qualifications of male teachers and female instructors who were employed on like work with, but paid less than, the men was a significant and relevant difference other than sex between their cases to which the difference in pay was genuinely due, holds the Court of Session in Glasgow City Council and others v Marshall and others 21.10.97, Court of Session. An industrial tribunal had erred in concluding that this causal connection was broken simply because the employers could have chosen to pay the women more.
