The facts

Mr Evans was employed by the respondent company for two and a half years as a setter-out. When his employment began, he was sent a letter stating the terms of his employment. This provided that his hours of work would be 8.30 am to 5 pm Mondays to Fridays and that overtime would be payable after the first five hours of extra time worked.
