Fixed-term contracts: Limited "extension" of fixed term did not invalidate waiver

This report relates to 1 case(s)

Bhatt v Chelsea & Westminster Health Care Trust and Charing Cross & Westminster Medical School [1997] IRLR 660 EAT (0 other reports)

A contract of employment for a fixed term may be "extended" or "renewed" as to its term or duration leaving that same contract in place, holds the EAT in Bhatt v Chelsea & Westminster Health Care Trust and another 9.9.97 EAT 479/97. It follows that when a contract for a fixed term of a year or more is extended or renewed in this manner by a lesser period, that extension does not necessarily invalidate an unfair dismissal waiver clause contained in or attached to the original contract.
