In Flannery v Tetley Walker Ltd ET/27541/79, the tribunal held that the redundant employee had had good reasons for refusing the two offers of alternative employment made to her and was therefore entitled to a redundancy payment.

Redundancy is a fair ground for dismissal (Employment Protection (Consolidation) Act 1978, section 57), but the employer has to show that it was fair and equitable to dismiss for redundancy.
