In Hardy v Gower Furniture Ltd the employment tribunal held that a disabled employee was discriminated against when he was offered alternative employment which his employer knew he could not do because of his disabilities, and made him redundant when he rejected them.

Mr Hardy, one of two forklift-truck drivers in the company's raw materials department, was employed from February 1988 to March 1997, when his employment was terminated.
