In R v Secretary of State for Education, ex parte Schaffter (30.7.86) EOR10D, Mr Justice Schiemann in the Queen's Bench Division rules that the statutory scheme for the provision of education grants which restricts hardship grants for lone parents to parents who have once been married is indirectly discriminatory on grounds of sex and contravenes the EEC Equal Treatment Directive. The decision offers useful guidance on determining the appropriate pool for comparison in indirect discrimination cases.
