In RJB Mining (UK) Ltd and others v National Union of Mineworkers 17.1.97, High Court, the High Court grants an injunction restraining a union from proceeding with industrial action on the basis of the union's non-compliance with the statutory requirements as to balloting. The union omitted to ballot a significant number of members whom it had intended to include in the ballot, and it balloted a substantial number who had ceased to be employed by the relevant employer at the time of the ballot.
