In JP Garrett Electrical Ltd v Cotton EAT/0547/05, the Employment Appeal Tribunal (EAT) has held that an apprentice was contractually entitled to receive a rate of pay equivalent to the national minimum wage, despite the fact that apprentices are excluded from the minimum wage legislation.
Mr Cotton was an apprentice and his terms and conditions provided that he would be paid not less than the national minimum wage.
