The facts

These consolidated German references relate to whether the right of an employee under German law to object to the transfer of his employment relationship in the event of a transfer of the undertaking in which he was employed is compatible with EEC Directive 77/187 on the approximation of the laws of the Member States relating to the safeguarding of employees' rights in the event of transfer of undertakings, businesses or parts of businesses.

The plaintiff in the Katsikas case was employed as a cook in a restaurant owned by the defendant.
