In Kelly v Riveroak Associates Ltd EAT/0290/05, the Employment Appeal Tribunal (EAT) has held that an employee's contract of employment was terminated by receipt by her of her P45 on 3 April 2004, even though the P45 stated the date of termination of employment to be 7 February 2004.
Mrs Kelly had not been working since 7 February 2004 - she was on unpaid leave while she was awaiting a response regarding whether she could work part time.
