The facts

The three applicants were employed as nursing lecturers at the Redwood College of Health Studies, which formed part of the National Health Service until 1 November 1994. Their contracts of employment provided that "your employment is governed by the conditions of the General and Nurses and Midwives Whitley Council." One of the Whitley Council conditions of service provided for an immediate payment of an enhanced retirement pension and other compensation in the event of an employee ceasing work on grounds of redundancy, in the interests of the efficiency of the service, or upon organisational change.
