Maternity rights: Failure to return from maternity leave terminated contract

The contract of employment of a woman who was unfit to return to work after maternity leave, already extended by four weeks because of her illness, terminated by operation of contract and of statute when she did not return on the notified date, holds the EAT in Crees v Royal London Insurance [1997] IRLR 85. The contract contained an express provision that failure to return would result in forfeiture of the right to return to work from maternity leave, and immediate termination of the contract.
