Stapp v The Shaftesbury Society [1982] IRLR 326 CA (0 other reports)

In our Guidance Note on the statutory date of termination (lRLIB 200), we examined the law relating to the effective date of termination for unfair dismissal purposes, and the relevant date for redundancy payments purposes. The Court of Appeal in Stapp v The Shaftesbury Society 7.5.82 confirms a number of the guidance points identified in our previous article, and adds that where notice of dismissal is superseded by summary dismissal, the effective date of termination is the date on which the summary dismissal is communicated to the employee, even if the summary dismissal is wrong in law.
