In Scottish Daily Record & Sunday Mail (1986) Ltd v Laird 4.4.95 (S)EAT 1164/94, the EAT upholds an industrial tribunal's decision that the dismissal of an employee, who concealed outside business interests which breached his contract of employment, was unfair primarily because his employer did not sufficiently investigate the circumstances to establish the extent of any competition involved.

Mr Laird was employed by Scottish Daily Record & Sunday Mail (1986) Ltd, a subsidiary of Mirror Group Newspapers plc, as deputy editor of the Sunday Mail.
