In Focus DIY Ltd v Nicholson 13.3.95 EAT 225/94, the EAT overturns an industrial tribunal's finding that the dismissal of a deputy manager for smoking cannabis while at a party with fellow employees was unfair. The tribunal erred in law by substituting its own view for that of the employer.
