Igbo v Johnson, Matthey Chemicals Ltd (EAT, 31.1.85) EOR1D holds that an employee who signed a letter that she accepted that her employment would automatically terminate if she failed to return to work on time from extended leave was not dismissed in law when the employers treated her contract as terminated when she failed to report for work on the due date because she was ill.
