The facts

The 10 appellants were employed by an independent boys' school Malvern College, nine as masters and the other as bursar. They had all taken advantage of a concessionary scheme operated by the school which permitted sons of masters to be educated at the school at a proportion, currently one-fifth, of the normal fee.
