In Fletcher and others v Blackpool Fylde & Wyre Hospitals NHS Trust and another [2005] IRLR 689, the EAT holds that trainee midwives could bring claims of unlawful sex discrimination against the NHS within s.14 of the Sex Discrimination Act 1975 ("the SDA"), and within the scope of the Equal Treatment Directive (76/207/EC) when their bursaries were stopped during periods when they were absent from their training due to their pregnancy.
