The Court of Appeal has upheld the EAT's decision in Khan v Heywood Middleton Primary Care Trust1, reported in Points of procedure.
It confirmed that rule 25 of the Employment Tribunals Rules of Procedure, which states that once a claimant has filed a notice of withdrawal of a claim "proceedings are brought to an end", means that the claimant cannot apply to revive a withdrawn claim.
