In two recent decisions, Berry v Bethlem & Maudsley NHS Trust1 and Hinks v (1) Riva Systems and (2) Lumsden2, the new President of the EAT has directed attention to the answers given by employers to the statutory questionnaire. The EAT allowed Mrs Berry's appeal against a tribunal finding rejecting her complaint that in not shortlisting her for a post, the employer had victimised her for having previously brought a race discrimination complaint.
