Race discrimination: Post-employment discrimination was not actionable
This report relates to 1 case(s)
D'Souza v Lambeth London BC All ER (D) 346 (May) CA (1 other report)
An employment tribunal had no jurisdiction to consider a complaint that the decision not to reinstate an unfairly dismissed employee had been caused by continuing race discrimination and victimisation, holds the Court of Appeal in D'Souza v London Borough of Lambeth 25.5.01 Court of Appeal. The Court was bound by its decision in Post Office v Adekeye (No.2) IRLR 105, and the tribunal had been right to conclude that that was fatal to the complainant's case.
