Race discrimination: Removal of cap on compensation was not retrospective
This report relates to 1 case(s)
Lambeth London Borough v D'Souza IRLR 240 CA (1 other report)
In London Borough of Lambeth v D'Souza 16.12.98 Court of Appeal, the Court of Appeal holds that an employment tribunal had no jurisdiction to increase an award of compensation for unlawful race discrimination which was made before the Act that removed the cap on such awards came into force. That Act applied only to cases where compensation was awarded for unlawful race discrimination after it came into force, and the award in question was not expressed to be anything other than final.
