In our Guidance Note on Fair Disciplinary Action (IRLIB 202) it was shown that in unfair dismissal cases Tribunals consider procedure as one factor among many to be taken into account when considering the fairness of a dismissal, and that the test of fairness is whether the ultimate decision to dismiss fell within the range of possible reasonable responses by the employer. In Iceland Frozen Foods v Jones the EAT has reviewed the decisions on the test of reasonableness as required by s.57(3) of the EP(C)A.
