In Calor Gas Ltd v Bray 12.09.05 UKEAT/0633/04/DZM, the EAT holds:
- The employment tribunal was incorrect to hold that, in the case of a woman who was on maternity leave at the time she was made redundant, redundancy consultation was automatically extended to the end of her maternity leave.
- It is open for an employer to dismiss on the grounds of redundancy during the maternity leave period, subject to reg.
