Employees who are dismissed by reason of redundancy may sometimes lose their right to a redundancy payment if they carry on working for the same employer after the specified dismissal date. In S Jones Industrial Holdings Ltd v Jarvis and another, the EAT holds that two employees had not forfeited their right to a redundancy payment where they were retained in a different capacity and there was no clear agreement between the parties for their existing contracts of employment to be extended.
