This article summarises the main issues and outcomes in five employment tribunal cases where the key issue was whether the employee resigned or was dismissed. Although the decisions are not binding on other tribunals, they provide useful illustrations of how careful employers have to be when there is any confusion or doubt over the manner of the termination of the employee's employment.
