Sex discrimination: Complaint of sexual harassment at appraisal interview rejected

In British Telecommunications Ltd v Williams [1997] IRLR 668 the EAT overturns an industrial tribunal's decision that an employee suffered sex discrimination when an interview to consider her poor annual performance appraisal was conducted in a way that led to the situation becoming "sexually intimidating" for the employee. The EAT holds that the appeal must succeed, as the tribunal expressly rejected the specific allegations of sexual harassment on which her complaint was based.
