Sex discrimination: Part-timer can bring unfair dismissal complaint

Unfair dismissal compensation is "pay" under Article 119 of the Treaty of Rome, holds the EAT in Mediguard Services Ltd v Thame. Therefore, the qualifying hours thresholds for bringing an unfair dismissal complaint, which the House of Lords has held to be incompatible with EC equality law, cannot preclude such a complaint by a woman part-time employee, whether she works in the public or private sector.
