In Wheeler and another v Durham County Council 23.5.01 Court of Appeal, the Court of Appeal restores the finding of the employment tribunal that it would not draw an inference of sex discrimination on the evidence before it. The tribunal was not required to seek an explanation of every allegation made but to make conclusions on the essential issues. There must be a nexus between the facts relied on and the discrimination complained of before an explanation from the employer is required.
